Terms of Service

Please read these terms carefully. They explain how buying and selling on Yews works and what we expect from everyone using it.
1. About these terms
Yews is an online marketplace where people buy and sell pre-loved baby and children's goods. These terms are an agreement between you and us. By creating an account or using Yews, you accept them. If you don't agree, please don't use the service.
Our Privacy Policy explains how we handle your personal information and forms part of these terms.
2. Our role
Yews provides the platform, payment handling and delivery booking. Sales are made directly between buyers and sellers: we are not the seller of any item, we don't inspect items, and we don't guarantee their quality, safety, legality or that a listing is accurate. Sellers are responsible for what they list and buyers for checking a listing before they buy.
Most sellers are private individuals. Where a seller is not selling in the ordinary course of business, some protections under the Consumer Protection Act may not apply to that sale. Nothing in these terms limits rights you have by law that can't be limited.
3. Your account
- You must be at least 18 years old and able to enter into a binding contract.
- Give accurate details and keep them up to date. Each account comes with one store for selling.
- Keep your password safe. You're responsible for activity on your account; tell us straight away if you think it has been misused.
- We may suspend or close accounts that break these terms, put other users at risk, or that we're required to act on by law.
4. Selling
When you list an item, you confirm that:
- you own it and are allowed to sell it;
- the photos, videos and description are yours to use and show the actual item, including any wear, damage or missing parts;
- it is safe to use, is not subject to a product recall, and meets any safety standard that applies to it;
- you'll hand it over for delivery (or collection) promptly after it sells, using the delivery option the buyer chose.
You give us a non-exclusive, royalty-free licence to display, resize and share your listing content to operate and promote Yews.
5. Items you can't sell
Because these goods are used by babies and children, the following are not allowed:
- recalled products, or anything that has been modified from its original design;
- car seats that have been in an accident, are past the manufacturer's expiry date, or have an unknown history;
- cots, bassinets or sleep products that don't meet applicable safety standards, and loose sleep positioners or cot bumpers;
- opened or used feeding consumables, formula, medicines, and personal-hygiene items such as used breast-pump parts, dummies or teats;
- counterfeit or stolen goods, and anything illegal to sell in South Africa.
We may remove any listing that we believe breaks these rules, without notice.
6. Buying and payment
Prices are in South African rand. At checkout you'll see the item price, the delivery cost for the option you choose, and our buyer service fee. The total shown is what you pay. Payments are processed by Peach Payments; we don't store your card details. If a payment completes after your order has expired or been cancelled, we credit the amount to your wallet.
An order is confirmed once payment succeeds. Unpaid orders expire after a short time and the item becomes available again.
7. Buyer protection and release of funds
Your payment is held by us and isn't released to the seller until you confirm you've received the item. If you don't confirm or report a problem within the period shown on your order after delivery, the payment is released to the seller automatically.
If something is wrong — the item didn't arrive, is significantly not as described, or is unsafe — report it from your order before the release period ends. We'll review the order and may ask both sides for information. Our decision on where held funds go is final as far as the platform is concerned, but doesn't affect your legal rights against the other party.
Buyer protection is optional and added by default at checkout for a fee shown before you pay. If you choose not to add it, you won't be charged the fee, but you won't be able to report a problem or open a dispute on that order. Your payment is still held and released to the seller in the same way.
Refunds we approve are credited to your Yews wallet.
8. Delivery and collection
Deliveries are carried out by third-party couriers (such as Pudo lockers and door-to-door services), under their own terms. Sellers must pack items safely and hand them over within the time shown on the sale. Where a seller offers local pickup, the buyer and seller arrange the handover themselves; please meet in a safe, public place.
9. Wallet and payouts
Sale proceeds and refunds are credited to your wallet. Sellers can withdraw their available balance to a South African bank account in their own name; payouts are sent by instant EFT through Peach Payments and usually arrive the same day.
We may hold or reverse wallet credits linked to a disputed order, suspected fraud, or a chargeback, and we may need to verify your identity or bank details before paying out.
10. Using the platform fairly
- Keep payment on the platform — don't ask for or accept payment outside it. Off-platform sales aren't covered by buyer protection.
- Be honest and respectful in messages and reviews. No harassment, spam, or misleading reviews.
- Don't scrape, overload, or try to break or get around the security of the service.
- Don't use another person's account or personal information without permission.
11. Reviews
After a completed order, buyers can review the store, the item and the delivery. Reviews must reflect a genuine experience. We may remove reviews that are abusive, unrelated to the order, or break the law, but we don't edit their content.
12. Liability
To the extent the law allows, Yews is provided "as is", and we aren't liable for indirect or consequential loss, or for loss caused by another user, an item, or a third-party service such as a courier or payment provider. Where we are liable, our total liability for any claim is limited to the fees you paid us on the order concerned.
These limits don't apply to liability that can't be excluded by law, including for gross negligence or fraud.
13. Changes and ending your account
We may update these terms from time to time. If a change materially affects you, we'll let you know in the app or by email before it takes effect. Continuing to use Yews after that means you accept the updated terms.
You can stop using Yews at any time. Open orders, held funds and wallet balances are settled before an account is closed.
14. Governing law and contact
These terms are governed by the laws of the Republic of South Africa. Questions or complaints can be sent to support@yews.co.za.
